The following General Terms and Conditions apply to purchases from KOMBARDO EXPRESSEN
The General Terms and Conditions have been updated and apply from 2 January 2019.
These General Terms and Conditions apply to the purchase of travel and passenger carriage using the KOMBARDO EXPRESS bus service.
The KOMBARDO EXPRESSEN buses are run by Herning Turist ApS, and the Party to the Agreement is Herning Turist ApS, Taksvej 8, 7400 Herning, CVR no. 19 99 57 39.
3.1.1 'Passenger' means any natural person who is or will be transported by bus in accordance with agreement with Herning Turist ApS.
3.2 'Baggage' means items transported in connection with a passenger carriage agreement. Baggage can be divided into 4 categories:
3.2.1 'Hand baggage' means the baggage a Passenger has in his or her possession, including a pram or the like.
3.2.2 'Bicycle' means the bicycle(s), including any trailer, brought by a Passenger in or outside the bus.
3.2.3 'Valuables' means money, securities, silver, gold, watches, jewels, jewellery and works of art.
3.2.4 'Other baggage' means baggage which is not covered by the definitions in sections 3.2.1, 3.2.2 and 3.2.3.
4.1 The present General Terms and Conditions apply to any agreement on carriage entered into with Kombardo Express, regardless of whether a document is issued. In addition to this, the Conditions of Carriage on the KOMBARDO EXPRESS website apply.
4.2 Herning Turist ApS cannot be held liable for loss, direct or indirect, including loss of revenue, beyond the rules of mandatory legislation.
4.3 Herning Turist ApS limits its liability as much as possible under the rules of the law.
4.4 Unless mandatory rules provide for other jurisdiction, all disputes with Herning Turist ApS must be settled at the home court of Herning Turist ApS.
4.5 Reservation is not a guarantee of carriage, but is considered to be a free capacity inquiry on the departure in question.
4.6 Reservations will be automatically deleted if the Passenger has not checked in with the bus driver for the relevant departure within the deadline applicable to the relevant ticket type. These deadlines are shown when purchasing the ticket and at the KOMBARDO EXPRESS website.
4.7 Departure times stated by Herning Turist ApS are considered to be approximate, and Herning Turist ApS does not guarantee that they will be complied with. Herning Turist ApS assumes no liability for service interruptions in terms of connections to trains, coaches and other means of transport.
4.8 Herning Turist ApS reserves the right to charge an additional fee if Passengers board the bus without paying or travel with the wrong ticket type.
4.9 Herning Turist ApS reserves the right to increase ticket prices and passenger fees etc. without prior notice. This also applies if the Passenger has already made a reservation.
4.10 Herning Turist ApS reserves the right to charge a fee for payment using a payment card.
5.1 There is no right of withdrawal for contracts for passenger carriage, see section 1(4)(iv) of the Danish Consumer Contracts Act (Forbrugeraftaleloven).
5.2 If the ticket type allows it, a ticket may be changed to another departure on the same route within the validity period. For example, a ticket from Aarhus to Copenhagen can be changed to another departure from Aarhus to Copenhagen. It is not possible to change return tickets so that both trips depart from the same region.
5.3 Low-Price tickets are valid for up to one month from the original travel date and can be changed for a fee up to 45 minutes before the agreed departure time. Low-Price tickets will not be refunded, neither fully nor partly. The number of Low-Price tickets available on the different departures varies, and Low-Price tickets are sold according to the first come, first served principle. Herning Turist ApS reserves the right to charge a fee of DKK 39 for changing the ticket.
6.1 Herning Turist ApS is not liable for the time before the Passenger boards the bus and after the Passenger has alighted.
6.2 The KOMBARDO EXPRESS travels by Molslinjen A/S's high-speed ferries. However, in special circumstances, Herning Turist ApS reserves the right to change the route and travel via Funen without notice.
6.3 Herning Turist ApS is under no circumstances liable for live animals transported as Baggage.
6.4 Herning Turist ApS is not liable for loss of Valuables.
6.5 Herning Turist ApS is solely obliged to compensate for losses caused by the loss of or damage to Baggage due to an incident during the carriage, if the loss or damage was due to the fault or neglect of Herning Turist ApS itself or someone for whom Herning Turist ApS is responsible.
6.6 A summary of passenger rights in case of incidents during the carriage with Herning Turist ApS is set out in Appendix A to these General Terms and Conditions and can be found at www.kombardoexpressen.dk.
6.7 Herning Turist ApS is solely obliged to compensate for loss or damage caused by delay in the carriage of Passengers or the carriage or delivery of Baggage due to the fault or neglect of Herning Turist ApS.
6.8 Herning Turist ApS is entitled to leave the carriage, or part of it, to another bus company. If a particular part of the journey is carried out by another bus company, Herning Turist ApS will not be liable for loss, damage or delay occurring during the part of the journey carried out by the other bus company.
7.1 Bicycles and other goods transported by bus may get dirty and get minor scratches during transport. The transport of such goods is the Passenger's responsibility, and Herning Turist ApS assumes no liability therefor.
8.1 To be able to reserve or pay for a ticket from Herning Turist ApS via the website, you must register with the following personal information: name, telephone number, postal code and email address.
8.2 If a search for lost property is initiated or materials etc. are ordered from the KOMBARDO EXPRESS website and are to be sent by post, the following information is also registered: name, street address, city and country.
8.3 The information is transmitted and stored in unencrypted form. When you have registered with Herning Turist ApS, you will always have the right to object to the registration, and you have a right of access to the information registered about you. 8.4 The personal data are registered with Herning Turist ApS and stored for up to five years, after which the data are deleted, unless an active customer relationship exists, where it may be in the customer's interest that Herning Turist ApS knows about and uses the data in question, or if the customer has given consent for the data to be stored for longer. Herning Turist ApS does not store customer data in encrypted form.
8.5 The following groups of employees have access to the registered information: the administration and the accounts department. Herning Turist ApS's servers and statistics systems are handled by Herning Turist ApS's IT suppliers and commercial partners, including Molslinjen A/S.
8.6 Backups of the content on the servers, including any personal data, are stored for up to five years, or longer if required by law. The data are stored with Herning Turist ApS's hosting and data processing partners. All information is confidential and belongs to Herning Turist ApS.
8.7 Herning Turist ApS collects information for the purpose of delivering the products ordered. In connection with reservation and payment, the information is also collected in order to make possible subsequent changes to the reservation and in order to be able to send a receipt. Herning Turist ApS carries out automated processing of customer, purchase and travel data in order to be able to target offers and communication in the best possible way to the individual customer.
On www.kombardoexpressen.dk, we collect information about your visit to the website. We do this in order to optimise the website, and data is analysed for different purposes, including targeted marketing. The information cannot be attributed to you as a person, but only to the computer from which you have visited the website. The information is collected via cookies. You can read more about cookies in the following. You must be aware that when visiting www.kombardoexpressen.dk, you consent to the guidelines described in the cookie policy below.
9.1 What are cookies, and how are they used?
Cookies are a standard technology that virtually all websites use. A cookie is a small text file that is added to your browser's memory. Among other things, it means that we can keep track of your ticket order. In addition, it gives us statistics that we use to improve our website for our users. Most browsers (e.g. Internet Explorer, Google Chrome, Mozilla Firefox, Safari etc.) are set to accept cookies automatically, but you can change the settings so that cookies are not accepted. Doing so, however, means that many websites, including www.kombardoexpressen.dk, will not work optimally. Cookies are not programmes running on your PC, but are small text files that are sent to and from your computer. Cookies are not spyware or viruses, so they are not harmful to your computer. Cookies can be divided into cookies that disappear when you close your browser (session cookies) and cookies stored on your computer (permanent cookies). Permanent cookies will be deleted after a given period/time interval. In addition, there is a distinction between cookies which have www.kombardoexpressen.dk as a sender (first-party cookie) and cookies which have been sent by one of our partners – typically our media agency. In that case, it is a third-party cookie.
9.2 Overview of cookies at www.kombardoexpressen.dk
QuotedTicketsKey: A cookie that will be added in connection with a booking. The purpose of this cookie is to retrieve the prices first offered to the customer. This means that the price the customer was shown is always the price the customer is shown when they get to the payment window. The cookie is a first-party cookie and is a permanent cookie that will be deleted after 15 minutes.
ARRAffinity: Used by Azure on which the website is hosted. Azure uses the cookie to determine whether the site should be scaled (if a larger machine is to be used). The cookie is a first-party cookie and will be deleted as soon as the browser is closed.
ASP.NET_SessionId, LB and AWSSELB are associated with payment. They will be deleted as soon as the browser is closed or the payment goes through. The cookie is a third-party cookie.
Online Marketing Cookies: KOMBARDO EXPRESS uses advertising on the Internet and cookies so that KOMBARDO EXPRESS and our media agency can count the number of clicks, visits and the effect of advertising on the Internet. KOMBARDO EXPRESS uses technical solutions provided by Adform, Facebook and Google Remarketing. These solutions add an anonymous cookie on visits to selected places on the KOMBARDO EXPRESS website, and when Internet banners for KOMBARDO EXPRESS are displayed or clicked on. All data stored are anonymous. The Adform cookies that are placed have the following names and expiry dates:
uid is a permanent cookie that expires after two months.
cid is a permanent cookie that expires after two months.
Token is a session-specific cookie.
_ga is a permanent cookie that expires after two years.
_gid is a permanent cookie that expires after 24 hours.
_gat is a permanent cookie that expires after 10 minutes.
DV is a permanent cookie that expires after one day.
tr is a permanent cookie that expires after three months.
CONTENT is a permanent cookie and will not be deleted.
NID is a permanent cookie and will be deleted after one year and five months.
All Adform and Google remarketing cookies are third-party cookies.
Web analytics cookies: To ensure continual improvement of the Kombardo Express website, anonymous statistics are collected using the Google Analytics web analytics tool. The purpose of these cookies is to count the number of visits from different browsers or computers. In addition, Google Analytics stores cookies indicating the source of traffic for a visit and how the user has navigated at www.kombardoexpressen.dk. All cookies stored by Google Analytics are anonymous and have a randomly generated user number. All Google Analytics cookies have a name that contains 'UTM' and are third-party cookies. 9.3 Disabling cookies

10.1 Log statistics are used on www.kombardoexpressen.dk, which means that a statistical system collects information that can provide a statistical view of numbers of visitors to a website, where they come from, in which part of the site the visit was abandoned and more. At www.kombardoexpressen.dk, log statistics are used for the purpose of optimising the website and its functionality and for increasing user-friendliness.
10.2 Herning Turist ApS and Molslinjen A/S holds the copyright to all material published on the website.
The material may not be distributed or reproduced without permission. You may freely link to information on the website. So-called 'deep links' are also allowed, please contact kombardo@kombardoexpressen.dk for direct links.
10.3 Herning Turist ApS reserves the right to change information and possible errors on the website. The information on the website is updated on a regular basis, but errors may occur. Herning Turist ApS is not responsible for direct or indirect loss due to the use of information on the website. Links to third-party servers are not the responsibility of Herning Turist ApS, and the content of a third-party server is not the responsibility of Herning Turist ApS. Downloads of documents from the Kombardo Express website are at the user's own risk.
10.4 By using this website, the user accepts the terms of this document. The content is updated as required, so that you as a user will always know what information Herning Turist ApS collects and why. Herning Turist ApS reserves the right at any time to amend, add or remove parts of the document. Therefore, please visit these pages and check if something has been changed. By continuing to use the KOMBARDO EXPRESS website after changes have been made, the user accepts the changes. By ordering a ticket via www.kombardoexpressen.dk, the user agrees that Herning Turist ApS uses personal data as described by Herning Turist ApS in this document. Herning Turist ApS complies with the Danish Act on Processing of Personal Data (Persondataloven).
11.1 If you wish to complain about your purchase, please contact Herning Turist ApS at kombardo@kombardoexpressen.dk. If we fail to find a solution, you can file a complaint with the Danish Competition and Consumer Authority's Complaints Resolution Centre, Carl Jacobsens Vej 35, 2500 Valby, via www.forbrug.dk.
11.2 You can also use the European Commission's online dispute resolution portal, which will, however, mainly be relevant if you are a consumer domiciled outside Denmark. You can find the portal here: http://ec.europa.eu/consumers/odr/. When submitting a complaint, please provide our email address kombardo@kombardoexpressen.dk.
11.3 The right to complain lapses after 180 days, since some of the details we use to process your complaint are deleted after this period.
Regulation (EU) No. 181/2011 lays down a minimum of rights for passengers travelling by bus within the European Union.
The rights resemble those applicable to air, train and ship passengers and include:
A right to equal treatment irrespective of nationality with regard to prices and transport conditions
Non-discrimination of disabled persons and persons with reduced mobility, including assistance free of charge at designated terminals and on board the bus and the right to financial compensation for loss of or damage to mobility equipment.
Adequate and accessible information for all passengers during their journey and access to general information about their rights at bus terminals and on the Internet.
Right to reimbursement of the full ticket price or re-routing of the journey in case of overbooking, cancellation or delay of more than two hours from the scheduled departure time (only applies to journeys where the scheduled distance is 250 km or more)
Right to compensation amounting to 50% of the ticket price, in addition to the reimbursement of the full ticket price, if the bus company fails to offer the passenger the choice between reimbursement or re-routing (applies in cases of overbooking, cancellation or delay of more than two hours from the scheduled departure time for journeys where the scheduled distance is 250 km)
Right to adequate assistance (e.g. snacks, meals, refreshments and, where necessary, accommodation) in the event of cancellation or delay of more than 90 minutes (only applies to journeys with a travel time of more than three hours where the distance is more than 250 km)
Right to compensation in the event of traffic accidents resulting in death, personal injury, loss or damage to baggage

Creation of independent bodies in all EU Member States authorised to enforce the Regulation and possibly impose fines.
